WHYTE, David C, 45, 17 Fresh Holes Rd, Hyannis; OUI liquor, negligent operation of a motor vehicle, marked lanes violation, state highway traffic violation February 22 in Yarmouth.  Pretrial conference scheduled for March 29.

DISPOSITIONS

CONNELL, William B, 47, 33 Cranberry Ln, Dennisport; assault & battery, intimidating a witness November 22 2010 in Yarmouth.  Jury trial.  Both counts dismissed.

TIERNEY, James F, 51, 31615 North 138th, Scottsdale AZ; OUI liquor, marked lanes violation August 28 2010 in Yarmouth.  Jury trial.  Guilty finding.  Continued for payment until March 23.

MEDEIROS, Jordan C, 39, last known address 86 Vidal Ave, E. Falmouth; unarmed burglary, amended to breaking & entering at nighttime for felonious purposes November 1 2010 in Falmouth.  Guilty plea.  One year house of correction and committed shock program, concurrent with docket 10cr - 711.

CUSHING, James, 50, 10 Orchard Rd, P.O. Box 390, Mashpee; assault & battery, December 11 2010 in Mashpee.  Pretrial conference scheduled for April 8.

LABOY, Luis A, 18, 43 Courtland St, Providence RI; motor vehicle homicide by negligent operation, negligent operation, unsafe operation, speeding and marked lanes violation August 4 2010 in Bourne.  Pretrial conference scheduled for April 7.  Laboy was involved in a rollover vehicle crash August 4 2010.  Two person were ejected from their vehicle, including Laboy.  The other, Bruce B. Brown did not survive.  The third passenger remained trapped in the car.  Both Laboy and the third passenger sustained serious injuries.

NEMATO, Bobbi M, 21 Simpson Ln Apt F, Falmouth; larceny over $250, vandalizing property, entering a dwelling at nighttime for the purpose of a felony, possession of burglary instruments December 21 2010 in Falmouth.  Pretrial conference scheduled for April 14.   A local resident returned from the Thanksgiving holiday to find the lock on her door had been pried or jimmied open.  $1000 cash was missing, along with an ivory bracelet worth $3000.  The resident's neighbor, Nemato, admitted to her that she had broken in because she was "off her meds."  Nemato was summonsed on that basis.

DISPOSITIONS

MADDOX, George E III, 36, 33 Pondview Dr, Mashpee; sex offender failure to register, November 1 2009 in Mashpee.  Bench trial.  Guilty finding.  Six months in house of correction, suspended.  Probation until February 22, 2012.  Continued for payment until March 21 2011.

PAGANI, John A, 48, 291 Little Sandy Rd, Plymouth; OUI liquor, driving the wrong way on a state highway, negligent operation of a motor vehicle February 6 in Bourne.  OUI:  admitted to sufficient facts.  Driving the wrong way on a state highway:  not responsible.  Negligent operation:  admitted to sufficient facts.  24 D program.  Continued until February 22 2012 without a finding.
