ARRAIGNMENTS

VILLA, Richard J, 21, 52 Curlew Way, Cotuit; Class A drug possession, heroin; speeding, April 18 in Sandwich.  Pretrial conference scheduled for May 18.  According to police reports, an officer pulled Villa over for speeding and noticed a ripped corner of a plastic bag, a piece of cotton wadding and an amber pill vial with the label scratched off inside Villa's car.  A search of Villa turned up a $20 bag of heroin inside his left sock.  After his arrest, the police report said Villa handed over another $20 bag of heroin he had concealed in his shorts.

BAXTER, Melissa, 26, 492 Rte 6A, Sandwich; assault & battery, April 19 in Sandwich.  Pretrial conference scheduled for May 10.

JOHNSON, Christopher M, 37, homeless, Hyannis; indecent assault & battery on a person 14 or over, April 15 in Barnstable.  Pretrial conference scheduled for May 17.

PUSATERI, Joseph J, 47, 373 Craigsville Beach Rd Apt #C, Centerville; three counts, violating an abuse prevention order March 26 in Barnstable.  Pretrial conference scheduled for May 31.

WARD, Ira L, 51, 800 Bearse's Way, Apt. #52, Hyannis; larceny under $250 by false pretenses, March 16 in Barnstable.  Pretrial conference scheduled for May 31.  According to police reports, Ward approached the victim in the parking lot of Home Depot, offering a $198 Home Depot Gift Card for the price of $80.  The victim confirmed the card balance in the store, and sent a friend out to pay Ward $80.  When the victim tried to use the card at the checkout, the balance showed zero.  Store management reported that Ward, described by the victim as having "strange teeth" and driving a silver sedan, had perpetrated a similar scheme the previous day, running up credit on the card by "returning" items he had removed from store shelves.

BRENNAN, Cynthia J, 63, 20 Capt. Morgan Rd, E. Sandwich; unlicensed operation of a motor vehicle February 5 in Barnstable.  Dismissed.

FAJARDO, Santiago, 31, 17 Hiramar Rd, Hyannis; assault to rape a child, accosting or annoying a person of the opposite sex September 25 2010 in Barnstable.  Jury trial.  Both counts dismissed.

LLRENA, Jorge B, 44, 275 Rte 28, Apt #102, W. Yarmouth; two counts, assault & battery, March 5 in Yarmouth.  Both counts, guilty plea.  Both counts, guilty finding.  First count, six months house of correction, committed, 113 days credit.  Second count, six months house of correction, concurrent with count #1.

PHILLIPS, Corneilius, 26, 6 Nequarta Rd, Nantucket; Class D drug possession with intent to distribute, November 26 2010 in Barnstable.  Dismissed upon forfeiture of $723 to Cape and Islands District Attorney's Office.

RAFUSE, Steven M Jr, 33, 122 Snake Pond Rd, Sandwich; assault & battery with a dangerous weapon, amended to assault & battery; assault & battery; mistreating a police horse or dog; vandalizing property; resisting arrest April 16 in Sandwich.  Guilty plea, all counts.  Guilty finding, all counts.  Six months house of correction, all counts to run concurrent at #09.3473.

RANDALL, John W, 26, 1625 Orleans Rd, Harwich; threatening to commit a crime, possession of a firearm without a Firearm Identification Card (FID) November 21 2010 in Harwich.  Threatening to commit a crime, probation terminated.  Defendant dismissed.  Possession of a firearm without an FID, dismissed February 18 2011.

APPEARANCES

WALLING, Richard J, 20, currently held on $250,000 bail at the Barnstable County H/C, appeared in court today for a routine scheduled status hearing.  Walling is charged with 2 counts of manslaughter in connection with the deaths of Ryan Aponte and Leonard Bolia who died from multiple stab wounds on January 8, 2011 at the White Pines Motel on Cranberry Highway. Walling is represented by Attorney Jack Atwood.  He is due back in court on May 3, 2011.

ARRAIGNMENTS

FERREIRA, Kevin C, 23 North Main Street, Carver; B&E daytime for felony, putting person in fear, larceny of a firearm, and larceny from a building, arrested April 15 on a warrant stemming from an incident on March 28, when Ferreira allegedly was confronted by a homeowner while in the commission of the offense.  The case has been continued for trial.  Ferreira released on $5000 bail.

SPANO, Michael, 7 Russell Holmes Way, Carver; B&E daytime for felony, putting person in fear, larceny of a firearm, and larceny from a building, arrested April 15 on a warrant stemming from an incident on March 28, 2011.  Bail set at $5000, case set for trial.

FITZPATRICK, Michael T, 46, of 12 White Pine Road, Apt. 3, Wareham.  Possession with intent to distribute Class B substance, Klonopin,  possession with intent to distribute Class B substance, Suboxone, possession with intent to distribute Class B substance, Oxycodone, possession with intent to distribute Class A substance, heroin, stemming from an April 16 Depot Street, Wareham  traffic stop.

LUDWIG, Adam, 26, 2 Ash Street, Middleboro, possession of Class A substance, heroin on April 18.  Middleboro Police responding to a call involving two males “shooting up” in the parking lot of a local business allege that they discovered Ludwig in possession of the drug.  Case continued, Ludwig released on bond.

DISPOSITIONS

OICLES, Tara, 29 of 461 Montponset Street, Hanson, admitted to sufficient facts to warrant a guilty finding in a case dating back to October 2008 involving theft of inventory from New England Farms, Cranberry Highway, Wareham, where Oicles had been an employee.  Oicles was sentenced to “1 year, continued without a finding” as well as $4145 restitution to New England Farms.
