ARRAIGNMENTS

CARCINELLI, Kim A, 44, 15 Whittier Dr, Dennis; OUI, third offense, amended to second offense; OUI drugs; marked lanes violation; state highway traffic violation; license not in possession, May 13 in Yarmouth.  Pretrial conference scheduled for June 30.  According to police reports, Carcinelli was refused alcohol at the Water Wheel liquor store.  The reporting party, who had been behind her in line at the liquor store, followed in his car from concern for her safety.  He watched Carcinelli cut off another car on Route 28 exiting the parking lot of the Stop & Shop, and almost hit a guard rail near Long Pond Rd.  Carcinelli reported use of Flexeril (a muscle relaxant) and Ativan (an anti-anxiety medication).  Carcinelli failed field sobriety tests and was arrested.

CHILDS, Stephen M, 50, 145 Cammett Rd, Marstons Mills; assault & battery, May 15 in Barnstable.  Pretrial conference scheduled for June 20.  No contact with victim except regarding visitation.

GALLAGHER, Sharon R, 24, 761 Depot St, Harwich; OUI liquor, May 8 in Yarmouth.  Pretrial conference scheduled for June 13. 

LEWIS, Timothy, 21, 4 Overlook Dr, Sandwich; destruction of property over $250, May 15 in Sandwich.  Pretrial conference scheduled for June 20.  According to police reports, someone smashed in the rear passenger window of a resident's 2005 Chevy Equinox LT.  Neighbors found chunks of the black baseball bat used in the crime in front of the vehicle.  One piece of the bat was engraved, "Tim Lewis - Barnstable Bat Company."  Asked about the crime, Lewis' brother said, " I don't know nothing.  I played Xbox all night."

LOPEZ, Carlos A, 41, 1815 Falmouth Rd Apt G2, Centerville; OUI liquor, operating a motor vehicle with a suspended license, marked lanes violation May 14 in Yarmouth.  Pretrial conference scheduled for June 20.

PONTE, Jeremiah P, 32, 77 Winter St, Hyannis; Class E drug possession with intent to distribute, Seroquel, May 14 in Barnstable.  Pretrial conference scheduled for June 9.  Seroquel is a prescription medication used in the treatment of major depression, bipolar disorder and schizophrenia.

PUSATERI, Joseph J, 47, 195 Falmouth Rd Apt D17, Falmouth; violating an abuse prevention order May 14 in Barnstable.  Pretrial conference scheduled for June 14.

STEWARD, Calvin M, 39, 57 Cottonwood Rd, Harwich; assault & battery, May 16 in Yarmouth.  Pretrial conference scheduled for June 8. 

DISPOSITIONS

COFRAN, Jessica L, 25, 4 Brookshire Cir, Mashpee; OUI liquor, negligent operation of a motor vehicle, January 9 in Barnstable.  OUI liquor, dismissed.  Negligent operation, admitted to sufficient facts.  Continued without a finding, continued for payment until May 15 2012.

HEWITT, Alan W, 47, 2 Andrea Way, Forestdale; assault & battery on a police officer, vandalizing property, resisting arrest February 21 in Sandwich.  All counts dismissed.

JONES, Earnest W, 37, 1 Salt Kettle Ln, S. Sandwich; forgery of check; uttering a false check December 13 2010 in Sandwich.  Guilty plea, both counts.  Guilty finding, both counts.  Continued for payment, probation until May 15 2012.

LOPES, Tinisha M, 27, 70 Winter St Apt #F, Hyannis; larceny of a motor vehicle, resisting arrest, March 9 in Barnstable.  Larceny of a motor vehicle, dismissed.  Resisting arrest, guilty plea.  Guilty finding.  Seven days, house of correction.  Seven days credit.

PANTON, Courtney J, 22, 30 Colby Rd, Bridgewater; receiving stolen property over $250, April 24 2009 in Rochester.  Guilty plea.  Guilty finding.  Two years, six months house of correction, one year suspended.  Restitution of $500.  Continued for payment, probation until May 10 2013.

PANTON, Courtney J, same as above.  Breaking & entering at daytime for felonious purposes, larceny over $250 July 18 2009 in Sandwich.  Breaking & entering, dismissed.  Larceny over $250, guilty plea.  Guilty finding.  Two years house of correction, one year to be served, balance suspended.  Continued for payment, probation until May 10 2013.  Restitution of $284.

PANTON, Courtney J, same as above.   Breaking & entering at nighttime for felonious purposes, larceny over $250 March 23 2010 in Sandwich.  Breaking & entering, guilty plea.  Guilty finding.  Two years, six months house of correction, one year to be served, balance suspended.  Larceny, dismissed.

PANTON, Courtney J, same as above.  Larceny over $250; three counts, breaking & entering; destruction of property less than $250, January 28 2010 in Yarmouth.  Larceny over $250, guilty plea.  Guilty finding.  First count of B&E, guilty plea.  Guilty finding.  Counts #1 and #2, two years house of correction, one year to be served, both sentences concurrent.  Restitution of $550.  Two counts, B&E, dismissed.  Destruction of property less than $250, dismissed. 

PANTON, Courtney J, same as above.  Receiving stolen property under $250, March 28 2010 in Sandwich.  Guilty plea.  Guilty finding.  Two years house of correction, one year to be served, both sentences concurrent.  Continued for payment, probation until May 10 2013.  Restitution of $150.

PANTON, Courtney J, same as above.  Receiving stolen property under $250, September 2 2009 in Barnstable.  Dismissed.

PANTON, Courtney J, same as above.  Breaking & entering at nighttime for felonious purposes, larceny over $250, March 22 2010 in Sandwich.  Both counts dismissed.

REYES, Carlos A, 41, 1062 Main St, P.O. Box 134, Chatham; OUI liquor, negligent operation of a motor vehicle, marked lanes violation April 18 in Chatham.  Pretrial conference scheduled for June 9.

SHEPPARD, Ralph J, 51, 18 Shamrock Cir, Harwich; OUI liquor, negligent operation of a motor vehicle, marked lanes violation May 15 in Orleans.  Pretrial conference scheduled for June 27.

DISPOSITIONS

FERREIRA, John C, 44, 435 Setucket Rd, E. Dennis; trespassing, dumping more than seven cubic feet of trash from a motor vehicle, February 28 in Dennis.  Pretrial conference scheduled for June 6.  According to police reports, JC Tree Services, in the person of Ferreira, dumped a large amount of pitch pine brush on a private road.  Police located Ferreira by his tire tracks.

HAMMOND, Stephen E, 23, 10 Old Tavern Rd, W. Chatham; shoplifting by concealing merchandise, March 29 in Harwich.  Admitted to sufficient facts.  Continued without a finding, administrative supervision until November 10.

ARRAIGNMENTS

HARNOIS, Wayne, 28, 210 Plymouth Rd., Fitchburg; assault and battery in Wareham on May 14. Released on $250 cash bail. According to the police report, A Wareham officer was dispatched to Cartland on Cranberry Highway for a report of a domestic assault. Harnois allegedly punched the victim three times in the face and fled the scene. Harnois was later apprehended in the woods off 2544 Cranberry Highway. He was located via cell phone GPS. Case continued to June 24 for pretrial hearing.

BURGO, Aaron, 22, 346 Staples St., E. Taunton; arraigned on charges of OUI, reckless operation of a motor vehicle and speeding on May 14 in Middleboro. Burgo was allegedly traveling at 94 mph in a 50 mph zone when stopped by police. He was released on his own recognizance to appear on June 16 for pretrial conference.

DURRAND, Mellissa B, 32, 89 E. Grove St., Apt. A3, Middleboro; assault and battery, domestic. Case continued to June 24 for pretrial conference.

FONTAINE, Antonio F, 74, 9 Akinbac Rd., Middleboro; appeared in court today after his arraignment on May 11 to determine bail eligibility after being charged with four counts of indecent assault and battery on a retarded person and one count of rape. Fontaine was originally held without bail pending today’s hearing. Bail was set at $10,000 cash.

SANTOS, Douglas W, 53, 2326 Cranberry Highway, W. Wareham; OUI 4th offense, leaving the scene after property damage and reckless operation of a motor vehicle. Santos was held on $1000 cash bail to await his next appearance on June 9.

DISPOSITIONS

KELLEY, Melanie A, 20, 51 Cliff Rd., Bourne; from a complaint issued October 18, 2010 in Middleboro, Kelley admitted to sufficient facts but continued without a finding until February 2, 2012 on charges of malicious destruction of a motor vehicle. Charges of breaking and entering for misdemeanor were dismissed.
