ARRAIGNMENTS

MACFARLANE, Marsha E, 60, 42 West St., Plimpton; MacFarlane was arraigned on charges of OUI and negligent operation of a motor vehicle. According to the police report, on June 10 Middleboro police were dispatched to Rt. 44 and Rt. 105 on a report of a head-on auto accident. Witnesses at the scene reported to officers that MacFarlane’s vehicle was allegedly traveling in the wrong lane and hit a truck in the oncoming lane. In court, MacFarlane was released on her own recognizance to appear on July 14 for pretrial conference.

REESE, Shawn, 22, 177 Highland St., Middleboro; Reese was arraigned on charges of OUI 2nd offense (drugs), and negligent operation of a motor vehicle from his arrest on June 12. According to the police report, Middleboro police were dispatched to McDonald's at 30 E. Clark St. on a report of a vehicle operator falling asleep in the drive-thru. When the officer arrived, management advised the officer that the operator of the vehicle was now asleep at a table. Further investigation revealed that the operator of the vehicle was allegedly under the influence of drugs. Reese was released on his own recognizance to appear on August 4 for pretrial conference.

O’DAY, Karen M, 40, 21 Hilltop Acres Drive, Lakeville; from an arrest on June 10, O’Day was arraigned on the charge of domestic assault and battery with a dangerous weapon (shovel) at the Hilltop Acres Drive address. O’Day was released on her own recognizance to appear on July 14 for pretrial conference.

LOYCANO, Anthony C, 43, 5 Wedgewood Place, Buzzards Bay; Loycano was held on $5,000 cash bail at his arraignment on charges of domestic assault and battery, assault with a dangerous weapon (lamp) and witness intimidation. Pretrial conference was set for June 29.

DISPOSITIONS

OSTROWSKI, John M, 48, homeless; from a complaint issued May 2, a single count of assault with a dangerous weapon was dismissed for lack of prosecution.

SNOW, John V, 51, 230 Lakeshore Drive, E. Falmouth; Snow was found guilty on the charge of leaving the scene of property damage from an incident on September 8, 2010. Snow was sentenced to 1 year house of correction, suspended, with probation to June 11, 2012.

ARRAIGNMENTS

PHILLIPO, Kayla, 27, 29 Wenham Rd., Carver; arraigned on the charge of assault and battery on a disabled person over 60. Phillipo was released on her own recognizance to appear on July 27 for pretrial conference.

SILVA, Denise, 41, 321 County Rd., Marion; Silva was arraigned on the charge of uttering a false prescription. According to the police report, Wareham police were dispatched to the CVS Pharmacy at 419 Main St. on June 9th on a report of a female attempting to fill a prescription for the painkiller Acetamin. Silva allegedly had called in the prescription herself, stating that the call was coming from a doctor’s office. Silva’s case was continued to July 27 for pretrial conference.

CARTER, Marcus, 17, 32 Chestnut St., Wareham; Carter was held on $25,000 cash bail on 3 counts of indecent assault and battery on a person over 14 and one count of rape from a complaint issued May 28 in Wareham. The case was continued to June 15.

BRUNO, Mark, 42,321 Wareham St., Middleboro; from a complaint issued May 18, Bruno was arraigned on 5 counts of assault with a dangerous weapon, a knife. According to the report, police were dispatched to the Wareham St. address on a report of a suicidal male. Upon arrival, Bruno allegedly threatened the responding officers with a knife.  Bruno was released on his own recognizance to appear on July 29 for pretrial conference.

INDICTED

MCMANARA, Thomas A, 378 Center St., Apt 7, Middleboro; McNamara was indicted by a Plymouth County Grand Jury on several charges of rape of a child with force, indecent assault and battery on a person under 14 and distribution of obscene material. He continues to be held at the Plymouth County House of Correction on $100,000 cash bail.

TAVERAS, Jessica, 19, 8 Pine Ridge Dr., Bourne; charges of possession with intent to distribute Class B drug and possession of Class B drug were dismissed by order of the court.

ARRAIGNMENTS

CARR, Thomas J, 21, 94 Tremont St., Carver; Carr was arraigned on charges of breaking and entering in a building, daytime, for felony, and larceny over $250 in connection with a breaking and entering on School St. in Pembroke in May where over $3,000 in jewelry was taken.  According to the police report, items recovered from a pawn shop at the Kingston Mall led to the identity of Carr. Carr was released on his own recognizance to appear for pretrial conference on August 5.

SEXTON, Jay, 301 Elm St., E. Bridgewater; from a complaint issued June 8, Sexton was arraigned on charges of OUI, marked lane violation, possession of Class E drug and possession of Class B drug from a motor vehicle stop on Ocean St. in Marshfield. According to the police report, an inventory search of the vehicle (incident to an arrest) turned up the drugs Suboxine and Seroquel. 

SMITH, Olahn E, 41, 507 Summer St., Rockland; from his arrest on June 10, bail was set at $1,500 cash at Smith’s arraignment on charges of possession of Class A drug (heroin) subsequent offense, and operating a motor vehicle with a revoked license. According to the police report, State Police on Friday, June 10 at 1:00 AM on Rt. 3 N. Duxbury pulled Smith’s vehicle over for having an expired inspection sticker. A license check revealed that Smith was a Habitual Traffic Offender and that his license had been revoked. An inventory search, incident to arrest, of the vehicle allegedly revealed a small package of “a brown powdery substance” consistent with heroin. The case was continued to July 6 for pretrial conference.

DISPOSITIONS

HACKETT, David R, 25, 120 Park Ave., Abington; from an arrest on November 18, 2010; Hackett entered guilty pleas to charges of possession of Class B drug and possession of Class B drug with intent to distribute. Hackett received probation until June 4, 2016. According to the police report, Abington police executing a search warrant at the Park Ave Address discovered 1,400 oxycodone pills and over $2,000 in cash.

SOMERS, Daniel J, 25, 15 Packard St., Plymouth; from a complaint issued April 2, 2010, Somers admitted to sufficient facts, continued without a finding to June 9, 2012, to the charges of OUI, resisting arrest and assault and battery on a police officer. According to the facts admitted, Plymouth police found Somers passed out behind the wheel of his vehicle on the on ramp at Rt. 3 South and exit 6. When police attempted to wake up Somers, a struggle ensued.

MIRANDA, David P, 59, 117 Forest Ave. Ext., Plymouth; from a complaint issued April 10, Miranda entered a guilty plea on the charge of carrying a dangerous weapon (spring assisted folding knife). Miranda was sentenced to 60 days house of correction.

ZENOPOULOS, Christie, 79, 49 Buckingham Way, Cotuit; from a complaint issued February 9 by Marshfield police, Zenopoulos plead guilty to 2 counts of lewd, wanton and lascivious conduct. He was sentenced to 2 years probation and ordered to stay away from the victim.

ARRAIGNMENTS

PHILLIPS, Brian M, 21, 56 Temple Rd., Marshfield; Phillips was arraigned on charges of breaking and entering in a building, night time, for felony, assault and battery, trespass, and destruction of property stemming from an incident on June 4. Phillips allegedly broke into a home on Morraine St. and attacked the victim.

GRUPILLION, Catherine T, 64, 280 Plymouth St., Pembroke; arraigned on charges of OUI, negligent operation of a motor vehicle, and marked lanes violation. The case was continued to July 15 for pretrial conference. According to the police report, Hanson police on June 7 answered a report of a vehicle operating erratically on Main St. Police allege that Grupillion hit a utility pole when being pulled over by the officer.

BENSON, Diane L, 43, 15 Matthews Trail, Plymouth; from a complaint issued May 4, Benson was arraigned on charges of aggravated assault and battery stemming from an argument with a neighbor. Police allege that Benson punched the victim in the face.

JONES, Justin T, 35, 68 Bettencourt Rd., Plymouth; from his arrest on June 7, Jones was arraigned on charges of assault and battery with a dangerous weapon (floor) and assault and battery stemming from a domestic incident. The case was continued to July 21 for pretrial conference.

DISPOSITIONS

CHAVES, Florentin, 26, 13 W. Green St., Lynn; received probation to June 2012 and 45 day loss of license on a charge of OUI.

GIAQUINTO, Thomas, 25, 14 Mayflower Lane, Marshfield; from an arrest in April, a charge of possession of class B drug was dismissed with court costs of $250. Giaquinto admitted to sufficient facts, continued without a finding until November 22, 2011 on a charge of conspiracy to violate drug laws.

WILLIS, Leon, 17, 7 Fox Rd., Plymouth; from a complaint issued March 9 by Plymouth police, Willis admitted to sufficient facts, continued without a finding for 18 months, on the charges of receiving stolen property, 6 counts of possession of Class E drug, 1 count of possession of Class A drug, possession of ammunition without FID card and possession with intent to distribute Class D drug.
