ARRAIGNMENTS

LONGANBACH, Scott M, 46, 56 Longwood Ave., Apt. 32, Onset; from an arrest on June 25, Longanbach was arraigned on charges of possession of Class B drug, cocaine, and operating without a license from a motor vehicle stop at 2:30 am on Rhode Island Rd., by Lakeville police. Longanbach was originally stopped for not having an inspection sticker. Police became suspicious when the officer observed a female passenger not wearing any pants. After a further inquiry the officer concluded that the passenger was intoxicated and the operator, Longanbach, was operating the passenger’s vehicle without a valid driver’s license. Longanbach allegedly dropped a small package of what appeared to be crack cocaine on the street next to the vehicle.  The case was continued to July 28 for pretrial conference.

DISPOSITIONS

BLOOMSTEIN, Augie Jr, 30, 137 Haskell Ridge Rd., Rochester;  charges of OUI drugs and marked lane violation were dismissed for failure to prosecute.

MULLEN, Tim, 28, 2 Burfield Rd., W. Wareham; charges of disturbing the peace, assault and battery (domestic) and 3 counts of assault with a dangerous weapon were all dismissed for failure to prosecute. In a companion case, MULLEN, Nicholas, had charges of assault and battery (domestic), disturbing the peace and assault with a dangerous weapon dismissed for failure to prosecute.

ARRAIGNMENTS

FOLAN, Lauren E, 21, 84 Spofford Ave., Monponsett; Folan was arraigned on charges of OUI and negligent operation of a motor vehicle in Marshfield on June 24. Folan was released on her own recognizance to appear on August 10.

METCALF, Robert S, 64 Herring Pond Rd., Plymouth; Metcalf was arraigned on charges relating to a domestic disturbance on June 24. He was released on his own recognizance to appear on July 21 for pretrial conference.

SALVAGGI, Ryan V, 40, 35 Maple St., Kingston; arraigned on charges relating to a domestic disturbance at 22 Elder Ave. on June 24 in Kingston. Salvaggi was released on his own recognizance to appear on July 21 for pretrial conference.

STUTZ, Craig P., 36, 588 Center St., Pembroke; from a complaint issued April 15, Stutz was arraigned on 5 counts of improper use of a credit card less than $250 from the alleged unauthorized use of a company gas credit card after Stutz was no longer working for the company.

BIROLINI, Paul L., 51, 136 Washington St., Pembroke; from an arrest on June 19, Birolini was arraigned on charges of OUI, 5th offense, negligent operation of a motor vehicle and marked lane violation in Pembroke. Birolini was held without bail pending a dangerousness hearing.

SHERRILL, Daniel J., 25, 1312 Rio Blanco St., San Juan, TX; arraigned on a charge of larceny over $250 stemming from the alleged theft of $9,50 worth of items missing from Plymouth High School. Sherrill posted $500 bail for his appearance on July 6 for pretrial conference.

LANGLEY, John, 20, 23 Cherry St., Plymouth, and HAKKILIA, Shane, 21, 15 R. Stafford St., Plymouth; from an arrest on June 24, Langley and Hakkilia were arraigned on charges of breaking and entering, night, for felony, larceny over $250, vandalize property and trespassing. Langley and Hakkilia were released on their own recognizance to appear on August 15 for pretrial conference. According to the police report, the two were taken into custody after an investigation into a breaking and entering of a boat at 274 Cordage Park Plymouth.

SMITH, Jean M, 33, 311 Ferry St., Marshfield;  Smith was arraigned on charges including OUI, reckless operation of a motor vehicle and leaving the scene of an accident on March 15 In  Marshfield. Smith was released on her own recognizance to appear on August 16 for pretrial conference.

JOHN, Peter W., 30, 12 Howe Circle, Randolph, and JOHNSON, Steven R., 31, 36 Pearl St., Weymouth; from their arrests on June 23, the two men were arraigned on charges of home invasion, armed assault to rob, threatening to commit a crime and witness intimidation. According to the police report, police received several 911 calls reporting a home invasion at 46 Flagler Drive. The pair, allegedly armed with a shotgun, kicked in the front door of the residence while the occupants were watching TV, and demanded money and drugs. John and Johnson were apprehended in Cohasset after police obtained the license plate number from a witness near the scene of the crime. Both men were held without bail pending a June 29 dangerousness hearing.

DISPOSITIONS

O’CONNOR, Dennis V, 40, 19 Foster Ave., Marshfield; O’Connor admitted to sufficient facts on a charge of shoplifting by asportation. The case was continued without a finding with probation to December 22, 2011.

DELLROSSO, Phillip A, 22, 119 Forest Ave. Ext., Plymouth; from a complaint issued June 19, 2010, Delrosso admitted to sufficient facts to a charge of larceny over $250. The case was continued without a finding with probation to December 20, 2012. Dellrosso was ordered to pay $500 in restitution.

MCCARTHY, Patrick M, 27, 41 Chandler Mill Dr., Duxbury; from an arrest on February 13, 2011, McCarthy was found not guilty after a bench trial on a charge of OUI.

OAKS, Devon, 18, 11 Nokimis Rd., Buzzards Bay; from an arrest on January 25, 2011, charges of unarmed robbery, assault and battery and vandalize property were dismissed without prejudice for failure to prosecute.

MURRAY-BURNS, Richard J., 21, 2 Wildwood Rd., Plymouth; from an arrest on April 11, charges of assault and battery, assault with intent to murder, assault and battery with a dangerous weapon, possession of class D drug and defacing firearm serial number  were all dismissed at the request of the defendant. The charges were dismissed by the judge for the Commonwealth’s failure to be ready for trial. Murray-Burns had been held without bail since his arrest on April 11th.

FLEMMING, Francis, 25, 17 Pages Lane, Marshfield; from an arrest on January 9 by Marshfield police, Flemming was found not guilty after a bench trial on the charges of OUI, failure to stop and marked lane violation.

TEXEIRA, Jaider, 30, 113 Court St., Apt. S1, Plymouth; from a complaint issued October 18, 2010, Texiera admitted to a charge of OUI. The case was continued without a finding with probation to June 21, 2012, 24D alcohol program, 45 day loss of license and $600 in fees and assessments.

LEAHY, Charles P, 53, 68 Butler St., Apt. D3, Boston; from an arrest on June 2. 2011, Leahy entered a guilty plea on a charge of OUI 2nd offense. Leahy was placed on probation to June 21, 2012, ordered to participate in a 24D alcohol program, statutory loss of license, and pay fees and assessments.

WARE, Roger W, 29, 437 Pembroke Woods Dr., Pembroke; from an arrest on June 14, 2009, charges of possession of Class D drug with intent to distribute and possession of a firearm without a FID card were continued without a finding to May 17, 2012. The charges of possession of over one ounce of marijuana and unlawful possession of a firearm were dismissed.
