MITSIS, Alexander, 28, 30 Melissa Dr, W. Yarmouth; trafficking in heroin/cocaine/opium (Percocet); drug violation near school; carrying a dangerous weapon; unregistered motor vehicle, August 20 in Barnstable.  Pretrial conference scheduled for September 23.  According to police reports, the Street Crimes Unit pulled over a 2002 Chevy Tahoe driven by Mitsis because the vehicle was unregistered.  Mitsis was unable to produce a valid registration and the vehicle was seized (inventoried and towed from the scene).  During inventory, police found ninety-nine (99) oxycodone tablets without a valid prescription inside the Tahoe, as well as a can of Mace.  Mitsis was arrested.

PHILLA, Patricia A, 65, 87 River St, S. Yarmouth; OUI liquor; negligent operation of a motor vehicle; marked lanes violation August 19 in Yarmouth.  Pretrial conference scheduled for September 21.

POWELL, Harvey M, 48, 32 Lake Rd W., W. Yarmouth; assault, July 15 in Yarmouth.  Pretrial conference scheduled for October 14. 

SILVA, Sinezio C, 25, 67 Park St, Apt 4D, Hyannis; OUI liquor, second offense; negligent operation of a motor vehicle; assault & battery with a dangerous weapon, a beer bottle, August 20 in Barnstable.  Pretrial conference scheduled for September 19.  According to police reports, a Barnstable officer joined the Street Crime Unit en route to Park Street near Cape Cod Hospital, for a report of a possible fight.  Silva was held at gunpoint by the police.  He informed them he had been drinking with a friend and had come to Park Street "to settle something."  The reporting party stated Silva and an associate threw beer bottles at him striking him in the back of the head.  Police reported Silva was intoxicated.  He was arrested.

DASILVA, Welton M, 21 Dartmouth, Hyannis; OUI liquor; unlicensed operation of a motor vehicle; motor vehicle lights violation, June 12 in Yarmouth.  OUI, guilty plea.  Guilty finding.  One year loss of license, no 24D program.  Unlicensed operation, dismissed.  Lights, not recorded.  Continued for payment, probation until August 21 2012.

HOMAN, Erin, a.k.a. DAVENPORT, 35, 23 Washington St, Hyannis; larceny under $250, August 24 2010 in Barnstable.  Dismissed.

OLSEN, James P, 27, 250 Sea St, Apt 6, Hyannis; assault with a dangerous weapon; intimidating a witness, July 21 in Barnstable.  Both counts dismissed.

PHILLIPS, Nicholas T, 21, 6 Norquarta Dr, Apt 6, Nantucket; assault & battery, July 12 in Barnstable.  Dismissed.

FERNANDES, Gerald A, 68,14 Pierceville Rd., W. Wareham; from an arrest on August 22 by Wareham police,Fernandes was arraigned on a charge of possession of Class B drug. According tothe police report, officers found one oxycodone pill when searching Fernandespursuant to taking him into protective custody for being intoxicated in public.Pretrial conference was scheduled for October 18.

DISPOSITIONS

MATEUS, Christina M, 32,120 A Gibbs Ave., Wareham; from an arrest on February 20, Mateus admitted tosufficient facts to a charge of OUI. Her case was continued without a findingwith probation to February 21, 2012. Mateus was ordered by the court toparticipate in an alcohol program, pay $65 per month probation fee, and forfeither license for 45 days.

RICHARD, James lll, 22,15 Purchase St., Middleboro; from an arrest on March 28 by Middleboro police,Richard admitted to sufficient facts to a charge of OUI. The court continuedthe case without a finding to August 24, 2012 with probation. Richard wasordered to pay $65 per month probation fee, $600 in additional fees andassessments and give up his license for 45 days.

COBBS, Jeannette M, 35,14 Barrows St., Middleboro; from a complaint issued June 10 by Middleboropolice, Cobbs entered a guilty plea to a charge of shoplifting by asportationfrom a shoplifting incident at Benny's. Cobbs was sentenced to one year houseof correction, suspended with probation to May 8, 2013.

JOHNSON, Sean P, 21,UNKNOWN ADDRESS, Middleboro; from an arrest on June 14 by Middleboro police,Johnson admitted to sufficient facts to charges of OUI, negligent operation ofa motor vehicle, uninsured motor vehicle and driving with a suspendedregistration. The court continued the case without a finding with probation toAugust 21, 2012. Johnson was ordered to attend a program, give up his licensefor 45 days, pay $65 per month probation fee as well as $600 in additional feesand assessments.
