Articles on new police station and zoning for medical marijuana included

Provincetown voters will head to the town hall Monday, October 21, 2013 for a Special Town Meeting.  The Special Town Meeting is set to begin at 6 p.m. at which time residents will vote on 18 articles.

Highlights of the meeting will be two articles related to a new proposed police station and a zoning bylaw amendment for a medical marijuana treatment center in Provincetown.

Articles 6 and 7 are concerned with the new police station. If approved by voters, Article 6 - "Acquisition of VFW Property", would give the Board of Selectmen the green light to acquire the VFW property on Jerome Smith Road by "purchase, gift and/or eminent domain".  According to Article 6, the property at 3 Jerome Smith Road will be used for some municipal purpose including the location of a new police station or affordable housing.

Article 7, which also pertains to a new police station would get the voters' go ahead to spend $450,000 for the design, project management and related activities for the new station at 3 Jerome Smith Road.

Article 13 asks voters to add an amendment to the Zoning By-Law Article 1 - Medical Marijuana Treatment Center. The amendment would add the following definition:

Medical Marijuana Treatment Center (MMTC): means a not-for-profit entity registered under 105 CMR 725.100, that acquires, cultivates, possesses, processes (including development of related products such as edible marijuana infused products, tinctures, aerosols, oils, or ointments), transfers, transports, sells, distributes, dispenses, or administers marijuana, products containing marijuana, related supplies, or educational materials to registered qualifying patients or their personal caregivers. Unless otherwise specified, MMTC refers to the site(s) of dispensing, cultivation, and preparation of marijuana.

Article 13 also requests a modification to the By-Laws under Section 2440 D (Institutional):

D7  Medical Marijuana, RES1: NO, RES2: NO, RES3/RES B: BA, TCC: NO, GC, BA19, S: NO, M: NO

Footnote 19 would read:

The Planning Board shall be the Special Permit Granting Authority for Medical Marijuana Treatment Centers. Except no MMTC shall be permitted with a radius of 100 feet of a school or daycare center. The 100 foot distance is measured in a straight line from the nearest point of the facility in question to the nearest point of the proposed MMTC. Or take any other action relative thereto.

"BA" means a use authorized under a Board of Appeals Special Permit. See the Provincetown Zoning Map here.
