ARRAIGNMENTS

MADDOX, Cherie B,30, 1431 Iyannough Rd Apt 22c, Hyannis; concealing/selling/pledging a leased personalty April 20 in Barnstable.  Pretrial conference scheduled for May 20.  According to police reports, Maddox leased a 65" TV and a sectional sofa with cocktail table, end tables, lamps and an area rug.  The leaseholder made numerous attempts to contact Maddox, but she made neither payment nor reply.

SMULSKI, Andrea L, 20, 30 Lakewood Dr, Mashpee; eight counts, uttering a false check; eight counts, forgery by check; receiving stolen property under $250, larceny over $250 by single scheme February 20 in Barnstable.  Pretrial conference scheduled for May 16.  According to police reports, Smulski stole her father's checkbook.  He reported the theft to Mashpee police.  Smulski's checks are alleged to have been kited by his daughter, Smulski at the Cotuit and Hyannis Stop & Shops.

ADAMS, Earl J 3rd, 77 Winter St Hyannis; receiving stolen property over $250, September 18 2010 in Barnstable.  Dismissed.

CRABTREE, Douglas R Jr, 26, 24 Maple Ave, Centerville; assault, larceny over $250, intimidating a witness, vandalizing property March 5 in Barnstable.  Assault, larceny over 250, vandalizing property all dismissed.  Intimidating at witness, admitted to sufficient facts.  Continued without a finding, continued for payment until October 20.  Anger management.

DEFALCO, March J, 41, 74 Galleon Way, Marstons Mills; assault & battery, March 20 in Barnstable.  Dismissed.

GURONG, Shive Rom, 25, 236 Hinckley Rd, Hyannis; assault & battery, March 2 in Barnstable.  Dismissed.

HERBAUGH, John D, 32, 5 Harbor St, Sandwich; three counts, assault & battery on a police officer; two counts, destruction of property over $250; resisting arrest December 2 2010 in Sandwich.  All counts, guilty plea.  All counts, guilty finding.  Probation, continued for payment until April 20 2012.  Drug- and alcohol-free with screens.  Counseling.

HIROCKE, Michael C, 55, 520 Pitchers Way, Apt A, Hyannis; assault & battery, assault & battery with a dangerous weapon March 20 in Barnstable. Both counts dismissed.

PERRY, John J, 47, 91 Falmouth Rd Apt 15, W. Yarmouth; assault & battery with a dangerous weapon, assault & battery January 20 in Barnstable.  Both counts dismissed.

RESCIGNO, Francis M, 22, 16 Claus Way, Marstons Mills, assault & battery with a dangerous weapon, assault & battery, intimidating a witness February 9 in Barnstable.  Jury trial.  All counts dismissed.

SCHMID, Timothy R, 48, 15 Tourane Way, S. Yarmouth; OUI liquor, second offense; negligent operation of a motor vehicle; failure to stop/yield for a police officer; marked lanes violation April 12 in Barnstable.  OUI, second offense, guilty plea.  Guilty finding.  24D program.  Probation, continued for payment until April 19 2013.  Negligent operation, failure to stop for a police officer both dismissed.  Marked lanes, not recorded.  Restitution to Sandwich Hollows Golf Course.

STOUT, Shaun P, 35, 70 Lothrop Rd, Harwich; receiving stolen property December 5 2010 in Brewster.  Pretrial conference scheduled for April 26.  According to police reports, Brewster officers working with Harwich Police identified a suspect, Stout, per information from Stout's alleged accomplice in several recent breaking & enterings in the town of Harwich, Dennis, Yarmouth and Brewster.  Stout was observed pawning "Indian Jewelry" at Bass River Coins later found to have been stolen from 7 Bog Hill Rd.

STOUT, Shaun P, 35, 70 Lothrop Rd, Harwich; receiving stolen property over $250 December 8 2010 in Brewster.  Pretrial conference scheduled for April 26.  See STOUT, above.

TOTTEHNAM, Ryan E, 34, 6 Marie Ln, Harwich; violating an abuse prevention order, April 20 in Brewster.  Pretrial conference scheduled for May 19.

DISPOSITIONS

BRISENO, Viola, 50, 43 Race Point Rd, Apt Box 90, Provincetown; two miscellaneous bylaw violations, operating a business without a license and failure to dump a grease trap, January 28 in Provincetown.  Both counts dismissed.

CHERENFANT, Theodule, 56, Beriah Brooks Rd, Harwich; three counts, improper use of a credit card over $250;  improper use of a credit card under $250, credit card fraud over $250 May 28 2009.  All counts dismissed.  Defendant discharged.

LEACH, Gary D Jr, 43, 39 Bell Rd, Chatham; violating an abuse prevention order, August 2 2010 in Chatham.  Dismissed.  Defendant discharged.

MARGADO, Michael F, 32, Hogan Rd PO Box 35, Mashpee; OUI liquor, negligent operation of a motor vehicle, marked lanes violation April 17 2010 in Barnstable.  Per se plea:  admitted to sufficient facts.  24D program, completed.  OUI liquor, negligent operation of a motor vehicle, both dismissed.  Marked lanes, not responsible.  Defendant discharged.

ARRAIGNMENTS

ROSE, Robert A, 41, 11 A Whynot Court, Marion; A&B, domestic, trespassing, disorderly conduct, stemming from a domestic incident on March 24 at the Woods of Wareham Complex.  Rose allegedly punched the victim in the face and fled the scene when police arrived, later to be arrested on a warrant.

DISPOSITIONS

PARMENTER, Scott R, 49, 79 Plymouth St., Middleboro; from a complaint dated March 12, operating a motor vehicle after license suspension, guilty, 1 year probation.

OTHER COURT NEWS

Three individuals from Brooklyn, New York have had their cases dismissed in Wareham District Court in favor of an indictment handed down by a Plymouth County Grand Jury. Their cases will be heard in Brockton Superior Court where all face lengthy state prison sentences.  Shadrach Thompson,29, his twin brother Meshach Thompson,  and Ashante T. Bryant, 31 have been indicted on cocaine trafficking charges  stemming from an investigation and arrest by the Middleboro State Police in November 2010. The three remain in custody of the Plymouth County Sherriff’s Dept. on high cash bail.
